West London man wins 8 month parking charge battle over ticket on road that doesn’t exist

A West London man has won a parking charge battle with the council after eight months trying to convince them to cancel his fine.

Nearly a year ago he was given a ticket on a road he claims didn’t exist, MyLondon reported his claims at the time and he has now, finally, had his ticket cancelled by Harrow Council.

Hitesh Pabari received the ticket in May last year and among his claims was that a parking inspector, in plain clothes, hid behind a bush to issue him the PCN on a road he says even the AA couldn’t find.

Now, after months arguing with Harrow Council he has had his ticket dropped. He brought the ticket to the Traffic Penalty Adjudicator and reported the council to local authority, including his MP.

Hitesh said: “Finally I have had my fine dropped. I want to let everyone know that this has happened so that they can all get a refund and it is not just me. Everyone given a ticket on this road should have their money back. Now.

“It has taken me ages to get this refund so everyone in the area should know it has happened. It is Harrow Council making money when they shouldn’t be.”

His multiple attempts to get a refund had him contact Bob Blackman, the Conservative MP for Harrow East, and Blackman helped by bringing the issue up with Council officials.

Following his success in getting the fine dropped, he has urged anyone who has a parking ticket that they don’t believe is fair to not pay the fine and instead “fight it until the end”.

Hitesh now believes that thousands of pounds should be refunded to all other people who were given a charge on the road, or lack of it, in question.

Greenhill Way, Service Road, is where he received his ticket. He said that because it isn’t signposted properly and doesn’t “technically exist” everyone deserves a refund.

Back in October Hitesh told MyLondon his thoughts whilst still having the ticket hanging over his head, he said: “I am bringing my findings to the Traffic Penalty Adjudicator to get my money back. They are wicked in what they do.

“I have reported them (Harrow Council) to the local government and now it is with the adjudicators I will have to wait and see what they find.

“If the council loses they will have to pay back thousands.”

It wouldn’t be the first time such a phenomenon has occurred. Back in 2011 almost 20,000 people got parking and driving fines refunded by a local council because a man took them through the system.

Nigel Wise was fined £100 by Richmond Council when he parked with two wheels on the pavement and although his car was spotted by a CCTV patrol vehicle, it was using a type of camera that didn’t have the correct licence.

As a result of Nigel’s continuous attempts to get his money back the council was forced to cough up hundreds of thousands.

Despite Hitesh’s claims, a spokesperson from Harrow Council said: “The PCN was issued correctly in the first instance.

“It was refunded as we were unable to respond to the formal challenge within the statutory time frame of 56 days. Parking restrictions remain in place on the road.”

He replied and said: “This road does not exists any where. Police maps, Google maps, aa, so where did it come from, it needs to be challenged?

“I don’t agree with their statements (Harrow Council) it’s just an excuse so that they are able to get out of explaining all the faults I’ve found. They knew they did not have a chance for a second, so they used this as an excuse.

“This is mentally torturing me that they can do this and the whole process needs to be re looked at as they are taking the Mickey.”
